What We Are

Cape May Vacation Rentals is an online platform that lets property owners advertise vacation rentals in Cape May, New Jersey, and lets guests discover them and contact owners directly. We are a listings service only.

We are not a party to any rental agreement, and we are not a broker, agent, or insurer. Bookings, payments, and any rental contract are arranged directly between the guest and the property owner. We do not charge guests a service fee and take no commission on stays.

Eligibility

You must be at least 18 years old and able to enter into a binding contract to use the Site. By using the Site, you represent that you meet these requirements and that the information you provide is accurate.

For Guests

Inquiries you send are shared with the property owner so they can respond. Sending an inquiry does not create a reservation and does not obligate the owner to accept your request. Any agreement to rent, along with its price, availability, cancellation terms, and payment, is between you and the owner.

Listings are created by owners, not by us. We do not independently verify listings, owners, or guests, and we make no guarantee about the accuracy of any listing or the quality, safety, or legality of any property. Confirm all important details directly with the owner before you pay or travel.

For Owners

You are responsible for the accuracy of your listings and for keeping your rates, availability, and house rules up to date. You must have the right to rent the property you list and must comply with all applicable laws, including Cape May and New Jersey short-term rental rules, licensing or registration requirements, and tax obligations, such as collecting and remitting any applicable occupancy taxes.

You grant us a non-exclusive, worldwide license to host, display, and promote the content you publish (including photos and descriptions) for the purpose of operating and marketing the Site and your listing. You retain ownership of your content.

Owner Subscriptions and Payments

Listing a property requires a paid subscription. Subscription fees, billing periods, and the number of listings included in each plan are shown at checkout. Payments are processed by Stripe, and by subscribing you also agree to Stripe's terms.

Subscriptions renew according to the plan you choose until cancelled. You can manage or cancel your subscription from your billing dashboard. Except where required by law, fees already paid are non-refundable. If you reduce your package, the change takes effect at your next renewal: you keep the placements you have paid for until then, and the difference is not refunded. If a payment fails or a subscription lapses, your listings may be hidden until billing is resolved.

Acceptable Use

You agree not to misuse the Site. This includes posting false, misleading, or unlawful content; infringing anyone's intellectual property; harvesting other users' information; sending spam or circumventing the inquiry relay to collect contact details in bulk; attempting to interfere with or gain unauthorized access to the Site; or using the Site for any unlawful purpose.

Third-Party Services and Links

The Site relies on third-party services such as Stripe, and listings may link to external booking platforms such as Airbnb or Vrbo, including affiliate links. We are not responsible for the content, products, or practices of any third-party service, and your use of them is governed by their own terms.

Disclaimers

The Site is provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure, or that any listing or owner is accurately described.

Limitation of Liability

To the fullest extent permitted by law, Cape May Vacation Rentals will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from a rental, a dispute between a guest and an owner, or your use of the Site. Our total liability for any claim relating to the Site will not exceed the amount you paid us, if any, in the twelve months before the claim.

Indemnification

You agree to indemnify and hold harmless Cape May Vacation Rentals and its operators from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of your use of the Site, your listings or content, your rental transactions, or your violation of these Terms or any applicable law.

Termination

We may suspend or terminate access to the Site, or remove any listing or content, at our discretion, for example if these Terms are violated or if required by law. You may stop using the Site at any time and may cancel your subscription from your billing dashboard.

Governing Law

These Terms are governed by the laws of the State of New Jersey, without regard to its conflict-of-laws rules. Any dispute relating to the Site or these Terms will be subject to the exclusive jurisdiction of the state and federal courts located in New Jersey.

Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "last updated" date above. Your continued use of the Site after an update means you accept the revised Terms.
